Property and Succession:

  • Property is one of the essential elements of a person makes during his lifetime for many purposes like investment or an essential shelter requirement. Property can be of two types self-acquired property and ancestral property.

Self-Acquired: property that a person acquires or purchases with his own money and income.
Ancestral: property acquired by a great-grandfather, grandfather, father (परदादा) and passed on to the next generation up to the great-granddaughter/son (पड़पोती/पड़पोता)

  • Property Inheritance Law states transferring a person’s property, debts, titles, rights, and duties to another person after their death. The property in India can be inherited in two ways, i.e., through a Will or laws of succession when a person dies intestate (without making a Will).
  • In India, distribution of property is governed by the Hindu Succession Act of 1956 as (Amendment) Act, 2005.
  • Daughter’s Right in coparcenary/ancestral property  [Vineeta Sharma v. Rakesh Sharma, (2020) AIR 3717 (SC)]: After the Amendment of 2005, to the Hindu Succession Act 1956, by virtue of section 6, now daughters have equal rights, shares and liabilities as of that of the son in respect to the property of her father.
  • Right of Husband in Wife’s Property (Section 15), Right of Wife in Husband’s Property, Property inheritance Rights of an adopted child. 
  • Disputes regarding sanctioning of mutation of inheritance or will.
  • Registration of will after the death of testator.
